The proposition of I.E.Lykhovyd I.A. about the arrangement of the contract of distribution of purchases sale by remote from 03/01/2020.

This public offer agreement is concluded between the Seller from one side and the

Buyer, any person who has accepted this offer, from the other.

This contract is addressed to an indeterminate number of people.

When ordering any product or service on the site queenpolewear.com, you confirm your agreement to the terms of this public offer.

This Public Offer is valid until the new version of the offer is accepted.

Terms and definitions

In this offer, unless the context demands other requirements, the following terms have such meanings and represents its integral part :

User - any natural person or legal person who visits the site https://queenpolewear.com, which accepts all of the terms of this offer and is intended to order the Goods.

Payee - any natural or legal person who visits the site that makes orders on https://queenpolewear.com for purchasing the product henceforth confirms his agreement with all the terms of this offer.

Online Store - Official Online Store of the I.E. Seller Lykhovyd I.A. located on www.queenpolewear.com.

Within the scope of this agreement, the terms "Online Store" and "Store" as well as

https://queenpolewear.com internet site is equivalent and interpretable

authentically, in the context of the offer.

Product - the object of the agreement of the parties; clothing, accessories, and other items presented at the official online store for sale.

A promotional discount is a discount on a particular Product. The size of the discount

is indicated on the product page. The price of the Product has already been specified taking into account a promotional discount.

General provisions

2.1 The Seller sells the Goods through the Online Store, which is located on queenpolewear.com.

2.2 When ordering the Goods at the Online Store, the User agrees to the terms of sale of the Products posted on the Site. In case of disagreement with terms of sale the User must immediately cease using the service and leave the site https://queenpolewear.com.

2.3 The applicable terms of sale of the Goods, as well as information on

the Goods is a public offer according to Art. 633 of the Civil Code of Ukraine.

2.4 The Terms and Conditions can be changed by the Seller without informing

Users and Buyers unilaterally.

The new revision of the terms of this agreement shall enter into force upon its publication on the site unless other regulations provided by the contract itself.

2.5 The Contract shall enter into force upon its confirmation in any form of the purchase made by the Seller to the Buyer while accepting the order including the time since the Buyer has made an order via the telephone listed on the Site.

2.6 By notifying the Seller of his telephone number, e-mail, the Buyer agrees

on these means of communication to be used by the Seller, as well as by third parties involved in the fulfillment of obligations to the Buyer.

Data may be used to disseminate transmission of information for shipping order procedure as well as other information directly related to the fulfillment of obligations to the Buyer under this Public Offering.

Also, the information provided by the Buyer can be used for the distribution of promotions, promotional news, discounts, and other activities initiated by the Seller.

By executing the Order, the User / Buyer agrees that the Seller may entrust the Contract to a third party meantime remaining responsible for its implementation.

The subject of the contract

3.1 The subject of this Agreement is to enable the User to buy the Products presented on the online store.

The goods and the order of purchase

4.1 The Seller is obliged to ensure that all the products are represented and available on the online store.

Photos of the Product are illustrations to it, however, the actual external look of the Product may differ from the images posted on the site https://queenpolewear.com. In order to clarify the information on this Product at any time, the Buyer may contact the Seller or his representatives via the link at https://queenpolewear.com/contact-us/.

4.2 In case of the absence of the Goods ordered by the Buyer, the Seller has the right to exclude the Product from the Order or to cancel the Order, by notifying the Buyer by the email or over the phone.

4.3 The Buyer is solely responsible for providing any false information that resulted in the seller's inability to fulfill his obligations to the Buyer.

4.4 In the absence of full or partial pre-paid order, the Buyer is offered a replacement. In case of the absence of the replacement of the Goods the cost for the product is returned by the Seller to the Buyer in the way it had been initially provided by the Buyer, or in any other way agreed by both sides.

4.5 The maximum period for processing and collecting an order is 5 days. After

ordering on the Site, the Buyer is provided with the indicative information about the

date of the delivery by sending an email to the address indicated by the Buyer during the checkout or over the phone.

Delivery of the Order

5.1 Methods and the cost of the Goods’ shipping, depending on the method of the payments are listed on https://queenpolewear.com/shipping-details/.

5.2 Liability for any accidental damage or destruction of the Goods shall go to the Buyer from the moment of the transfer of the Order and putting it in documents by confirming the delivery of the Order with the signature of the Recipient.

Price and payment for the goods

6.1. The price of the Product is indicated in national currency and includes all

taxes provided by Ukrainian law. For Users / Buyers non-residents of Ukraine the equivalent of the price in foreign currency (Euro) is indicated.

6.2. The price of the Goods is stated on the Site. In case of incorrect pricing of the Goods ordered, the Seller informs the Buyer about confirmation of the Order due to the adjusted price of the Order or about its Cancellation.

6.3. The price of the Product on the Site is the subject to change by the Seller in one way order. In this case, the price of the Goods ordered by the Buyer is not subject to change.

6.4. Payment for the Goods is provided by the Buyer on terms of prepayment procedure.

6.5. The Seller has the right to provide discounts on Products and install a bonus program. Types of discounts, bonuses, procedure and conditions of their accrual indicated on the Site may be unilaterally modified by the Seller.

Exchange and Return of Goods

7.1 Return of the Goods is subject to the terms of return, listed on the Site: https://queenpolewear.com/exchange-and-return/.

7.2 The Buyer has the right to refuse the Goods received and to terminate the Contract of sale and purchase in accordance with the Law of Ukraine "On Protection of Rights of Consumers »within 14 calendar days.

7.3 The Seller is not responsible for the defects of the Goods that arose after the transfer to the Buyer as a result of the Buyer's violation of the Terms of Use or storage of the Product, the actions of third parties or circumstances of force majeure.

7.3.1 If the reason for the return is an online store responsibility, the full cost of the order is returned to the Buyer. Also, Online Store pays for the return of the Goods.

7.3.2 Under the mistake of the Online Store are ment such cases as: sending wrong models, sending a different size, color mismatch of the model of the photo (for example: instead of black, knee pads turned red). This does not take into account the discrepancy between the shade of the same color (bright red-coral), due to the fact that different monitors / gadgets may show the look of the same item in different ways.

Privacy and protection of information

8.1 The User / Buyer's personal data is processed in accordance with the Law of Ukraine "On Protection of Personal Data" and the information set out under the link: https://queenpolewear.com/privacy-policy/.

8.2 Personal data is collected solely for the purpose of complying with the requirements that regulate legal relations in the field of accounting and tax,advertising. The storage and processing of personal data comprises three years.

8.3. By submitting your personal data when registering on the site https://queenpolewear.com, the User agrees to its processing by the Seller, including the purpose of promoting goods and services by the Seller.

8.4. The Seller has the right to send information, including advertising on an e-mail and mobile phone of the User / Buyer with his / her consent. The User / Buyer has the right to refuse to receive advertising and other information without explaining the reasons of the refusal. Service messages informing the User / Buyer about the Order and the stages of its processing are sent automatically and can not be rejected by the User / Buyer.

8.5 The Seller may use cookies. Cookies do not contain sensitive information and are not disclosed to third parties.

8.6 The Seller is not responsible for the information provided by the User / Buyer on the Site in a public form.

8.7 The Seller shall have the right to record telephone conversations with the Buyer. In doing so, the Seller undertakes: prevention of unauthorized attempts of the access to the information obtained in the course of telephone conversations and / or transfer to third parties who are not directly related to the execution of Orders, in accordance with the Law of Ukraine "On Information".

Duration of the public offer

9.1. A valid public offering becomes effective from the moment of the acceptance by the User / Buyer and is valid until the withdrawal of the acceptance of the public offer.

9.2 By ordering the Product on Online Store, the User agrees with the terms of this public offering. In case of disagreement with the terms of sale the User must immediately stop using the service and leave the site https://queenpolewear.com.

Special conditions

10.1 The Seller has the right to delegate his rights and obligations to the Buyer to third parties.

10.2. Online Store and related services may be temporary / partially or completely unavailable due to prevention procedures or other technical reasons. The Seller's technical service is entitled to carry out periodically preventive or other work required with previously informed notification to Buyer or without it.

10.3. All provisions of the legislation of Ukraine are applied to the relationship between the User / Buyer and Seller

10.4 In case of questions and claims from the side of the User / Buyer, he has the right to contact the Seller by sending a letter / claim (contacts are posted on https://queenpolewear.com/contact-us/). The parties are obliged to try to resolve all disputes through negotiations. If the parties do not agree, the dispute will be subject to review in the courts of Ukraine.
